Event Terms

These Events Terms (the “Events Terms” or “EU Terms”) apply if you are located or ordinarily resident in the European Economic Area (EEA), Switzerland, or the United Kingdom.  

If you are located or ordinarily resident in the United States or any other jurisdiction outside the EEA, Switzerland, or the United Kingdom, these EU Terms do not apply to you. Instead, the U.S. Events Terms—which include a binding arbitration agreement and class action waiver—apply and are binding upon you.  

PESI, Inc. trading as PESI Europe (“Company”, “PESI”, “we”, “us”, or “our”) organise and host live, online, and in-person training and events under the “PESI Europe” brand (“Events”). These Events Terms govern your registration for, access to, and attendance at our Events. By registering for, accessing, attending, or participating in an Event, you accept and agree to be bound by these Events Terms as well as our Terms of Use. Any rules of conduct and other rules and policies set forth on our Event-related webpages or applicable to the Events also apply to your registering for, attending, and participating in Events and are hereby incorporated by reference. In the event of a conflict or inconsistency between these Events Terms and any other terms or agreements between you and us, these Events Terms shall control with respect to your registration for, participation in, or attendance of Events. 

Please read these Events Terms carefully before registering for, attending, or participating in Events. They contain very important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that might apply to you. 

You may not register for, attend, or participate in Events if you (a) do not agree to these Events Terms, (b) are not 18 years of age, or (c) are prohibited from registering for, attending, or participating in Events by applicable law. 

1. Interpretation and Definitions 

In these Events Terms, the words below will have the meanings provided next to them. The definitions will have the same meaning regardless of whether they appear in singular or in plural. 

  • Associated Entity means any entity that controls, is directly or indirectly controlled by, or under common control with, PESI. For the purposes of this definition, "control" (including, with correlative terms like "controlled by" and "under common control with") means the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of such entity, whether through the ownership of voting securities, by contract, or otherwise. 

  • Company (referred to as either "the Company", “PESI”, "we", "us" or "our" in this Agreement) refers to PESI, Inc. doing business as PESI Europe, 3839 White Ave, Eau Claire WI 54703, United States of America. 

  • Onsite Event means an event where attendees are physically present in a location. 

  • Live-StreamedEvent means a live event where attendees attend the event online.  

  • you or your(s) means the individual registering for, attending, or participating in an Event. 

2. Privacy 

We collect personal information about you through and in connection with your registration for, participation in, and attendance at Events. Please see our Privacy Notice and GDPR Addendum for more information regarding our collection, use, disclosure, and processing of your personal information. It also tells you about your privacy rights. Please read our Privacy Notice and GDPR Addendum carefully before registering for or attending Events. You have the option to manage your cookie preferences here.

We may share limited personal information, such as your name, email address, and registration details, with our partners that sponsor or are involved in organising an Event. Please see their own privacy notice regarding their processing of your personal data.  

3. Recording 

EVENTS MAY BE RECORDED. BY PARTICIPATING IN OR ATTENDING AN EVENT, YOU CONSENT AND AGREE TO SUCH RECORDING.  

4. Event Registration 

To participate in an Event, you must register on our applicable website and pay the registration fee (if any). Please review all of the information you have entered as part of your registration.  

If you register for an Event on behalf of other attendees or as a representative of a company or other organisation, you hereby agree to the Events Terms on their behalf and represent and warrant that you have authority to do so. You must also ensure that such other attendees and participants from the company or other organisation are made aware of, agree to, and shall be bound by these Event Terms. You are responsible for ensuring that you direct all communications regarding the Event to the persons on whose behalf you are registering. You must ensure that you provide us with complete and accurate information regarding anyone you register, and you agree to be solely liable for damages arising from any information you provide. You agree to indemnify and hold us and our officers, directors, employees, agents, contractors, and affiliates harmless from all liability, damages, judgments, and costs (including reasonable attorneys’ fees) arising from any claims brought by or on behalf of any third party related to your conduct, misconduct, or negligence in completing this registration on another’s behalf. 

By submitting a registration, you confirm that all of the information is accurate, true, and complete. Your registration for an Event may be delayed if you do not provide full details as part of your registration. 

To the fullest extent permitted by applicable law and without limiting any other of our rights, including the right to terminate or cancel any Event (including while the Event is occurring), we may cancel tickets (including purchased tickets) or registrations if we find, in our sole discretion (1) that your registration does not include the correct information or does not comply with the parameters set out in the Event description, (2) that you are in violation of applicable law, these Events Terms or the Terms of Use, or our policies or rules applicable to Events, (3) that your attendance may be harmful or objectionable to us, other speakers, participants, or third parties, (4) that we need to comply with a court order, or (5) that you are misusing or abusing any promotional offers, promotional codes, or discounts relating to an Event. 

We reserve the right to cancel registrations at a later time if they do not include the correct information or do not comply with the parameters set out in the Event description.  

All places on Events are allocated on a first-come, first-served basis. Event registration is subject to availability and may close earlier than the posted deadline, as determined in our sole discretion. We may also change the Event programme at any time in our sole discretion.   

You will receive joining instructions for a Live-Streamed Event along with the link to access it. Joining links are specific to you and you must not share them with others. They may be deactivated if shared. 

Cancellation terms, instructions, and the Event’s refund policy will be listed on the Event’s registration webpage. 

We may, in our discretion, allow you to transfer your ticket or registration to another individual if you are unable to attend, provided that the transferee meets all eligibility criteria and agrees to our Events Terms and Terms of Use. 

If you do not attend an Event, full fees will remain payable by you. 

5. Cancellations, Rescheduling, and Changes 

We reserve the right to cancel, reschedule, or change an Event at any time for any reason including, for example, availability or suitability of venue or speakers or on security, health, or safety grounds, and we may deny, limit, or cancel your Event registration at any time. We will not be liable for any damages, direct or indirect, resulting from such cancellation, rescheduling, or change, and you will have no claim against us in such an event. 

6. Intellectual Property 

By registering for an Event or attending or participating in it, you authorise and consent to us, and those acting on our behalf and authority (collectively, “Released Parties”) recording, capturing, or embodying your image, voice, likeness, name, biographical information, performance, and/or appearance (collectively, “Your Likeness”) during the Event in any medium, including, but not limited to, photographs, film, video, digital images, digital audio, or any other video or audio recordings taken or made of Your Likeness during the Event (collectively, the “Event Materials”), which may subsequently be displayed or disseminated without your consent or payment of any compensation to you. 

You also understand that if you choose to speak, submit questions, participate in breakout sessions, or use the chat function during the Event, your comments or contributions may be recorded, captured, transcribed, and used as part of the Event Materials. You grant the Released Parties a non-exclusive, perpetual, royalty-free licence to use, reproduce, publish, and distribute these contributions in any format or media for training, educational, archival, or promotional purposes. 

You consent to being recorded, filmed, and photographed and consent that Your Likeness and the Event Materials may be used, reproduced, exhibited, displayed, broadcast, and disseminated by the Released Parties, without further consent from or payment or compensation to you, for any purpose in any media (now known or hereafter devised) throughout the world in perpetuity, including but not limited to use in photographs, DVDs, broadcast, telecast, live streams, podcast, webcast, recordings, motion pictures, commercial advertisements, printed or digital materials, newsletters, or promotional materials. This consent includes, but is not limited to, the right to edit such media, the right to use the media alone or together with anything else, and the right to allow others to use or disseminate the media. You agree and understand that all rights in the Event Materials, including future and other rights not specifically described herein, shall be owned by PESI, Inc. in perpetuity and you waive any inspection, approval, or moral rights. 

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY UNCONDITIONALLY AND IRREVOCABLY RELEASE, FOREVER DISCHARGE, INDEMNIFY, AND HOLD HARMLESS THE RELEASED PARTIES AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM ANY AND ALL DAMAGES, LIABILITY, AND CLAIMS CAUSED BY, ARISING OUT OF OR IN CONNECTION WITH THE EVENT MATERIALS OR ANY USE, REPRODUCTION, EXHIBITION, DISPLAY, BROADCASTING, OR DISSEMINATION THEREOF, INCLUDING, WITHOUT LIMITATION, ANY AND ALL CLAIMS FOR INVASION OF PRIVACY, INFRINGEMENT OF RIGHT OF PUBLICITY OR COPYRIGHT, DEFAMATION (INCLUDING LIBEL AND SLANDER), AND ANY OTHER RIGHTS WHATSOEVER. YOU AGREE THAT THIS RELEASE MEANS YOU ARE GIVING UP, AMONG OTHER THINGS, RIGHTS TO SUE THE RELEASED PARTIES FOR INJURIES, DAMAGES, OR LOSSES THAT YOU MAY INCUR. YOU AGREE THAT THIS RELEASE BINDS YOU, AS WELL AS YOUR RESPECTIVE HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS. 

You agree not to make any audio or video recording of an event or of any part of an event in any manner, including, but not limited to, using a recording device or any automated or artificial intelligence system. 

7. General 

When you plan to attend an Onsite Event, it is your responsibility to arrange and pay for your own travel and accommodation. We are not responsible for assisting you to apply for a visa, and we are not responsible for any costs incurred by you as a result of your failure to obtain valid travel documentation or a visa (as required). 

We are not responsible for the safety, accessibility, or condition of any third-party event venues, accommodation, or travel providers, or for any incidents, delays, or losses that may occur during your travel to or from the Event. 

Views expressed by any attendee, speaker, exhibitor, or sponsor at the Event are their own and do not necessarily reflect the views of PESI. We shall have no liability for advice, opinion, statement, or information provided by any attendee, speaker, exhibitor or sponsor at the Event, whether made during the Event or in any related materials distributed to participants. Attendees are solely responsible for evaluating the accuracy, completeness, and usefulness of such content.  

8. Availability, Errors, and Inaccuracies 

We reserve the right to change or update information and to correct errors, inaccuracies, or omissions regarding the Events or any aspect thereof, including, but not limited to, pricing, availability, and qualification criteria at any time without prior notice. 

9. Safety and Security 

PERSONAL BELONGINGS OR OTHER ITEMS BROUGHT WITH YOU TO EVENTS ARE AT YOUR OWN RISK AND WE ACCEPT NO RESPONSIBILITY IN RELATION TO THEIR LOSS OR DAMAGE, WHETHER AT OUR PREMISES, AT THE LOCATION OF AN EVENT, OR ANYWHERE ELSE. 

You agree that you and your property may be subject to a reasonable search upon entry to an Event and you may be asked to provide photo identification. If you refuse to participate in these security measures, we may refuse you entry. We also reserve the right to ask you to leave an Event if your behaviour causes us concern for the safety or security of Event attendees. If we deny you entry or require you to leave, you will not receive a refund. 

We are not responsible for the actions or omissions of the venue, its staff, third-party service providers, or other attendees. You assume all risks associated with attending the Event, including risks of property damage, personal injury, illness (including exposure to communicable diseases), theft, or loss occurring at or around the Event premises. 

10. Code of Conduct 

Attendees are expected to behave in a respectful, inclusive, and professional manner at all times during Events, whether in person or online. Disruptive, abusive, discriminatory, harassing, or otherwise inappropriate conduct will not be tolerated. We reserve the right to deny entry to, or remove individuals from, an Event without refund or liability if their behaviour causes disruption, creates a hostile environment, or violates these Events Terms or applicable law. This applies to interactions with other attendees, speakers, staff, and any use of chat, Q&A, breakout rooms, or other interactive features. 

Anti-Harassment Policy 

PESI is committed to providing a safe, inclusive, and respectful environment at all Events. Harassment or discriminatory behaviour of any kind will not be tolerated. This includes, but is not limited to, unwelcome verbal, physical, or visual conduct based on race, gender, age, sexual orientation, disability, religion, or any other protected characteristic under European Union law. 

Attendees engaging in harassing behaviour may be removed from the Event without refund and may be barred from future participation. If you witness or experience harassment, please report it promptly to a member of staff. All reports will be handled confidentially. 

11. Miscellaneous 

Nothing in these Events Terms limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct. 

These Events Terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of the country where you habitually reside. 

These Events Terms, the Terms of Use, and any documents incorporated into these Events Terms by reference constitute the entire agreement between you and us regarding your registration for, attendance at, and participation in Events, and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of these Events Terms. 

We may transfer our rights and obligations under these Events Terms to another organisation, for example in connection with a merger or reorganisation. If this happens, we will ensure that your rights under these Events Terms are not affected and we will notify you of the change. You may transfer your rights or obligations under these Events Terms only if we agree in writing, except that your statutory rights (including your right to legal guarantees) remain unaffected. These Events Terms do not and are not intended to confer any rights or remedies upon any person other than you. 

If any provision of these Events Terms is held to be unenforceable, invalid, void or illegal, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect, failing which that provision will be deemed severed from these Events Terms and will not affect the validity or enforceability of the remaining provisions of these Events Terms. 

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Events Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach. The waiver by the Company of any right or provision will be effective only if in writing and signed by a duly authorised representative of the Company. 

These Events Terms are part of and subject to our Terms of Use, which include governing law and dispute resolution provisions. 

12. Changes to These Events Terms 

We may update these Events Terms from time to time to reflect changes in our business, services, or for other operational, legal, or regulatory reasons. If we make material changes, we will notify you in advance (for example, by email or via our website) at least 30 days before the new Events Terms take effect. If you do not agree to the updated Events Terms, you may terminate your account and stop using our services before the changes apply. No changes will apply retroactively, and your statutory rights remain unaffected.
